PLP preliminary injuction filed against State of California Department of Fish & Game to lift suction gold dredging ban

January 26, 2010

Public Lands for the People filed a preliminary injunction against the State of California Department of Fish & Game (DFG) on January 21, 2010.

The injunction, if approved by the court, would prohibit the DFG and the State of California from enforcing SB 670. SB 670 was the bill passed by the California legislature and signed by Governor Schwarzenegger in August 2009 that barred the DFG from issuing suction gold dredging permits until a new Environmental Impact Report on suction dredging is completed.

The case was originally scheduled to be heard by Judge Morrison C. England of the US District Court for the Eastern District of California on February 25, 2010. Judge England has moved the date back one month to March 25, 2010.

PLP president Jerry Hobbs stated the organization is still on track with their goal of restoring the rights of suction gold dredgers in California before the next dredge season starts.

The preliminary injunction is available in .pdf format.
